Viageur Terms of Service
Last updated: October 12, 2026
These Terms of Service ("Terms") are an agreement between you and LTY Enterprises, Inc., 6 Liberty Square, Boston, MA 02109, USA ("Viageur", "we", "us" or "our"). They govern your use of:
- the Viageur website at https://www.viageur.com; and
- the Cleared by Viageur mobile app for iPhone and Android.
Together these are the "Service".
By creating an account or using the Service, you agree to these Terms. Our Privacy Policy at https://www.viageur.com/privacy explains how we handle personal information. If you do not agree to these Terms, do not use the Service.
1. Eligibility
You must be at least 18 years old to use the Service. By using it, you confirm that you are 18 or older and can enter into this agreement. The Service is not directed to children.
2. Your account
- You sign in with a one-time link sent to your email address. Anyone who can open your email can sign in to your Viageur account, so keep your email account secure.
- You are responsible for activity on your account. Tell us promptly at support@viageur.com if you think someone has used your account without permission.
- Each account is for one person. Do not create accounts by automated means or under false pretenses.
3. The Service
Viageur provides city missions, checkpoints, dossiers, community intel and city briefings for travelers. We may change, add or remove features. Some features are available only on the website or only in the app.
4. Your safety in the real world
The Service involves going to real places. You are responsible for your own safety and for your own decisions about where to go and what to do.
- Information in the Service is not a guarantee that a place, route or activity is safe, open, accessible, legal or suitable for you.
- Follow local laws, venue rules and official guidance.
- Pay attention to your surroundings. Do not use the Service while driving, or in any way that puts you or others at risk.
- Do not enter private property or restricted areas to complete a mission.
- In an emergency, contact local emergency services. Do not rely on the Service.
5. Location features
Some features use your device's location with your permission. These include verified check-ins at mission checkpoints, nearby intel, location-tagged intel on the website and the website map. You can turn off location access at any time, but those features will not work without it. The Privacy Policy explains how location information is used.
6. Community intel and other content you submit
Your content. You keep ownership of the community intel and other content you submit ("Your Content").
Licence to us. You grant Viageur a worldwide, non-exclusive, royalty-free licence to host, store, copy, format, display and distribute Your Content, and to review and moderate it, in order to:
- operate and provide the Service;
- show Your Content to other users of the Service, including the location attached to intel submitted on the website; and
- generate city briefings from it (section 8).
This licence ends when Your Content is deleted from the Service. It continues only for copies we keep as described in the Privacy Policy, such as redacted moderation records and backups until they expire.
Your responsibilities. You confirm that you have the right to submit Your Content and that it follows these Terms. Do not include personal information about yourself or anyone else in intel. Write about places, not people.
Content rules. Do not submit content that:
- identifies, harasses, threatens, defames or invades the privacy of anyone;
- is false or misleading in a way that could put someone at risk;
- is unlawful, hateful or discriminatory, or promotes violence;
- is sexually explicit;
- infringes anyone's intellectual property or other rights;
- contains spam, advertising or malicious code.
Reporting, blocking and moderation.
- You can report community intel or block its creator in the Service.
- Reported intel is hidden from you, and intel that receives several reports is hidden while our team reviews it. Blocking hides the creator's intel from you.
- We may review, refuse, hide or remove content, and limit or end access to the Service, to keep the Service safe and enforce these Terms. We do not monitor all content and are not obliged to.
- You can also report content, or tell us you think your rights have been infringed, at support@viageur.com.
7. Content from other users
Community intel is written by other users. We do not check it in advance and do not guarantee that it is accurate, complete, current or safe to rely on. Use your own judgment.
8. AI-generated city briefings
City briefings are generated automatically by an AI model, provided by Anthropic, from recent community intel for a city. They are presented in the voice of a Viageur character. Briefings can contain mistakes and can repeat inaccuracies in the intel they are based on. They are for general information only and are not professional, legal, medical or safety advice.
9. Booking links and third-party services
The Service may link to third-party venues, booking pages and other services. Viageur receives commissions or other compensation for some of these links.
Bookings and purchases you make with a third party are between you and that third party, under its terms and privacy policy. We are not responsible for third-party services, their content or their availability.
The Service uses third-party services such as maps. Their content is subject to their own terms and attributions.
10. Favors, missions and clearances
Favors, levels, clearances and similar features exist only within the Service. They:
- have no cash value;
- are not your property;
- cannot be bought, sold, exchanged for money or transferred;
- may be changed, reset or removed.
Some actions in the Service may cost favors.
11. Acceptable use
You must not:
- use the Service unlawfully or to harm anyone;
- try to access other users' accounts or information;
- test, probe or scan the Service for vulnerabilities without our written permission, or get around any security measure or usage limit;
- scrape, crawl or copy the Service or its content by automated means, or use it to build a competing database;
- reverse engineer the app, except where the law allows;
- interfere with the Service, or misrepresent your location to obtain check-ins or favors.
12. Our intellectual property
The Service belongs to Viageur or its licensors, other than Your Content and third-party content. That includes its software, design, missions, dossiers, characters, text, graphics and the VIAGEUR name and marks.
We give you a limited, personal, non-exclusive, non-transferable and revocable licence to use the Service for your own non-commercial purposes under these Terms.
If you send us feedback or suggestions, we may use them without any obligation to you.
13. Mobile apps and app stores
- App stores. If you downloaded the app from the Apple App Store or Google Play, these Terms are between you and Viageur, not Apple or Google. Viageur, not Apple or Google, is responsible for the app and its content, maintenance and support.
- Apple users. Your licence to use the iPhone app is also subject to Apple's Licensed Application End User License Agreement. If that agreement conflicts with these Terms about your licence to use the app, that agreement applies.
- Store rules. The app store's own terms and policies also apply to your use of that store.
- Legal compliance. You confirm that you are not prohibited from receiving the app under the laws of the United States or any other country that applies to you.
14. Suspension and termination
You may stop using the Service at any time. Information about deleting your account is at https://www.viageur.com/account-deletion.
We may suspend or end your access to the Service in these cases:
- if you break these Terms;
- if the law requires it;
- if it is reasonably needed to protect the Service, our users or others.
Where reasonable, we will tell you why.
We may also stop offering the Service or any part of it. Sections that by their nature should continue after your access ends will continue, including sections 6, 12 and 15 to 19.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, VIAGEUR DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE OR ANY CONTENT, INCLUDING COMMUNITY INTEL AND CITY BRIEFINGS, WILL BE ACCURATE, COMPLETE, SAFE, UNINTERRUPTED OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW SOME DISCLAIMERS, SO SOME OF THIS SECTION MAY NOT APPLY TO YOU.
16. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- VIAGEUR IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM OR RELATING TO THE SERVICE; AND
- VIAGEUR'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID VIAGEUR FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AND US $100.
NOTHING IN THESE TERMS LIMITS OR EXCLUDES LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED BY LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FOR FRAUD.
17. Responsibility for your content and conduct
To the extent permitted by law, you are responsible for, and will reimburse Viageur for, reasonable losses and costs arising from third-party claims caused by Your Content or by your breach of these Terms. This section does not apply to the extent a claim results from Viageur's own fault. It does not limit any rights you have as a consumer that cannot be limited by law.
18. Governing law and where disputes are heard
These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Service will be heard in the state or federal courts located in Massachusetts, and you and Viageur agree to the jurisdiction of those courts.
If you are a consumer, nothing in this section removes:
- the protection of mandatory laws of the place where you live; or
- any right you have under those laws to bring proceedings in your local courts.
Before starting formal proceedings, please contact us at support@viageur.com so we can try to resolve the issue.
19. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Viageur about the Service. Where section 13 applies, Apple's Licensed Application End User License Agreement and the app store's own terms also apply as described there, and nothing in this section overrides them.
- Severability. If any part of these Terms cannot be enforced, the rest remains in effect.
- No waiver. If we do not enforce a part of these Terms, that does not waive our right to do so later.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours in connection with a merger, acquisition or sale of assets.
- Changes. We may update these Terms. We will post the updated Terms here with a new "Last updated" date. For significant changes, we will give reasonable notice, for example in the Service or by email. If you keep using the Service after the changes take effect, you accept the updated Terms. If you do not agree, stop using the Service.
